L’achat de biens et de services, de même que la commande de travaux, par un pouvoir public tel qu’une administration nationale, une autorité locale ou les organismes qui en dépendent, constituent les marchés publics.
L’ouverture de ces marchés, qui représentent une part importante du PIB de l’UE, a permis d’accroître la concurrence entre les entreprises de l’Union européenne, réduisant les prix et garantissant une meilleure qualité des services aux citoyens. Au fil des années, l’UE a mis en place des dispositions législatives qui modernisent et facilitent le processus de passation de marchés. Elle a renforcé la transparence, l’équité et l’interopérabilité en la matière par le biais d’outils tels que la base de données TED (Tenders Electronic Daily), le système de classification unique (matérialisé par le vocabulaire commun pour les marchés publics) ou le système d’information pour les marchés publics européens (SIMAP). Elle a également signé l’accord plurilatéral sur les marchés publics (AMP) et négocié au sein de l’Organisation mondiale du commerce (OMC) une procédure internationale de passation.
